The EC issued Conclusions of the 14th EU-Ukraine IPR Dialogue which took place in Kyiv, 6 July 2016. Full report can be found here.

Background

The EU-Ukraine Association Agreement entered into force on 1 January 2016. The DCFTA includes an ambitious IPR chapter aiming at regulatory approximation with the EU acquis and enforcement practices. However, Ukraine has not brought its IP laws in compliance with the Association Agreement. The current situation regarding collective management organisations causes irreparable damage to the legitimate interests of thousands of local and international rightholders. The Ukrainian legislation does not include adequate provisions ensuring effective enforcement of IPR rights; they are particularly unfit for enforcement in the digital environment. To be fully integrated in the world trading system, to continue to attract foreign investment and to prevent major losses for rightholders, Ukraine has to implement all its international obligations and the DCFTA urgently, in particular the ones related to intellectual property rights and their enforcement.
